We advise in disputes between neighbouring property owners, including boundary issues, trespass and rights of way.

These disputes often arise from day-to-day issues which escalate over time. We are regularly instructed in matters involving boundary disagreements, encroachments, fencing and access issues, as well as disputes concerning rights of way, easements and the use of shared areas.

Our work includes advising on the interpretation of title documents, plans and historical use, and dealing with issues such as obstruction of access, interference with rights, and ongoing nuisance. We also act in cases involving trespass, including where structures have been erected or land has been occupied without consent.

We understand that these disputes can become entrenched and, in many cases, involve ongoing relationships between neighbours. We therefore take a measured and practical approach, seeking to resolve matters through correspondence and negotiation where possible.

Where resolution cannot be achieved, we prepare matters properly and represent clients in proceedings, including claims for injunctions, declarations and damages.
